This stuff happens in comics, manga, and anime all the time. Although 'homage' and 'ripping' off is a gray area in itself, the same argument could be used for movies. Like one could say, for example, that Quentin Taratino is just ripping people off, or it could be viewed as a homage. Although it's more widely accepted as him paying homage to early films. I haven't read the comic, so I can't really say, as context and story says a lot, but just from that one pic, I don't see it as a big deal. /2cents I think he’s fine.
